Acceptance of Terms
By downloading, installing, or using the AI Background & Object Eraser application ("App") developed by AI Photo Labs ("we", "our", or "us"), you agree to be bound by these Terms of Use ("Terms").
If you do not agree to these Terms, you must not download, install, or use the App. We reserve the right to modify these Terms at any time. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.
Description of Service
AI Background & Object Eraser is a mobile application that provides AI-powered image editing tools, including but not limited to:
- Automatic background removal from photos
- Object and unwanted element erasing from images
- Image enhancement and editing features
- Export and sharing of edited images
The App utilizes cloud-based AI technology to process images. An active internet connection is required for core features to function.
User Accounts & Registration
Some features of the App may require you to create an account or sign in. You are responsible for:
- Providing accurate and complete registration information
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
Subscriptions & In-App Purchases
The App may offer subscription plans and in-app purchases ("Premium Features"). By purchasing Premium Features, you agree to the following:
- Billing: Payments are processed through Apple App Store or Google Play Store. All billing is managed by the respective platform.
- Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- Cancellation: You may cancel your subscription at any time through your device's App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period.
- Refunds: Refund requests are subject to the refund policies of Apple App Store or Google Play Store. We do not directly process refunds.
- Price Changes: We reserve the right to change subscription prices. You will be notified in advance of any price changes.
- Credits: If the App uses a credit-based system, unused credits may expire according to the terms specified within the App.
User Content & Intellectual Property
Regarding the content you process through the App:
- Your Content: You retain all ownership rights to the original photos and images you upload to the App.
- Edited Content: You own the edited/processed images generated by the App from your original content.
- License to Us: By uploading content, you grant us a limited, non-exclusive license to process your images solely for the purpose of providing the App's services.
- Our Content: The App itself, including its design, features, AI models, code, graphics, and trademarks, is owned by AI Photo Labs and protected by intellectual property laws.
Acceptable Use
You agree not to use the App to:
- Process, create, or distribute illegal, harmful, threatening, abusive, or objectionable content
- Infringe upon the intellectual property rights of others
- Create deepfakes or manipulated images intended to deceive or harm others
- Attempt to reverse-engineer, decompile, or disassemble the App or its AI models
- Interfere with or disrupt the App's servers or networks
- Use automated systems or bots to access the App
- Circumvent any usage limits, access controls, or security features
- Resell, redistribute, or commercially exploit the App's services without authorization
We reserve the right to terminate or restrict access for users who violate these terms.
Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Guarantees that the App will be uninterrupted, error-free, or secure
- Guarantees regarding the accuracy, quality, or reliability of AI-generated results
AI processing results may vary and are not guaranteed to be perfect. The quality of output depends on various factors including input image quality and complexity.
Limitation of Liability
To the maximum extent permitted by applicable law, AI Photo Labs and its directors, employees, partners, and affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of data, revenue, profits, or business opportunities
- Any damages arising from your use or inability to use the App
- Any damages resulting from unauthorized access to your data
Our total aggregate liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to its conflict of law provisions.
Any disputes arising under these Terms shall be resolved through negotiation in good faith. If negotiation fails, disputes shall be submitted to the competent courts of Vietnam.
