Acceptance of Terms

By downloading, installing, or using the AlterMe: AI Face & Video Swap application ("App") developed by KDSTUDIO ("we", "our", or "us"), you agree to be bound by these Terms of Use ("Terms").

If you do not agree to these Terms, you must not download, install, or use the App. We reserve the right to modify these Terms at any time. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

Description of Service

AlterMe: AI Face & Video Swap is a mobile application that provides AI-powered face and media editing tools, including but not limited to:

  • Face swapping in photos using AI
  • Face swapping in videos, GIFs, and short clips
  • AI portrait styles, avatars, and photo enhancement
  • Template-based creations and effects
  • Export and sharing of edited photos and videos

The App uses cloud-based AI technology to process media. An active internet connection is required for core features to function.

Eligibility & User Accounts

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. Some features may require you to create an account or sign in. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

Consent & Rights to Uploaded Faces

Face swapping involves the likeness of real people. This section is essential and you must comply with it at all times.

  • Your responsibility: You represent and warrant that you own, or have obtained explicit permission to use, every photo and video you upload — including the rights to the face of every person appearing in that media.
  • No minors: You must not upload images or videos of minors for face swapping.
  • No impersonation: You must not create content that impersonates a real person for the purpose of deceiving, defaming, harassing, defrauding, or harming them.
  • No sexual or explicit content: You must not create sexual, nude, or sexually suggestive content depicting any real person.
  • Disclosure: Content created with the App is AI-generated or AI-manipulated. When sharing it publicly, you should make that clear so viewers are not misled.
  • Compliance: You are solely responsible for complying with the laws of your jurisdiction regarding image rights, publicity rights, biometric data, and synthetic media.

Violation of this section is grounds for immediate termination of your access, and you are solely liable for any claims arising from content you create.

Subscriptions, Credits & In-App Purchases

The App may offer subscription plans, credit packs, and in-app purchases ("Premium Features"). By purchasing Premium Features, you agree to the following:

  • Billing: Payments are processed through the Apple App Store or Google Play Store. All billing is managed by the respective platform.
  • Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • Cancellation: You may cancel your subscription at any time through your device's App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period.
  • Refunds: Refund requests are subject to the refund policies of the Apple App Store or Google Play Store. We do not directly process refunds.
  • Price Changes: We reserve the right to change subscription prices. You will be notified in advance of any price changes.
  • Credits: Credits are consumed each time a face swap or video swap job is submitted. Credits are non-transferable, have no cash value, and may expire according to the terms specified within the App. Credits consumed by a successfully completed job are non-refundable, including when you are not satisfied with the aesthetic result.

User Content & Intellectual Property

Regarding the content you process through the App:

  • Your Content: You retain all ownership rights to the original photos and videos you upload to the App.
  • Generated Content: Subject to these Terms and to the rights of any person appearing in the media, you own the edited/processed photos and videos generated by the App from your original content.
  • License to Us: By uploading content, you grant us a limited, non-exclusive license to process your media solely for the purpose of providing the App's services. We do not use your content to train our AI models.
  • Our Content: The App itself, including its design, features, AI models, code, templates, graphics, and trademarks, is owned by KDSTUDIO and protected by intellectual property laws.
  • Templates & Assets: Templates, effects, and stock media supplied inside the App are licensed to you for personal use within the App only, and may not be extracted or redistributed.

Acceptable Use

You agree not to use the App to:

  • Create deceptive deepfakes, fake news, fake evidence, or content intended to mislead or harm others
  • Produce sexual, pornographic, violent, hateful, or otherwise objectionable content involving real people
  • Create content involving minors in any inappropriate context
  • Impersonate public figures, officials, or any individual for fraud, scams, or political manipulation
  • Process, create, or distribute illegal, harmful, threatening, abusive, or defamatory content
  • Infringe upon the intellectual property, privacy, or publicity rights of others
  • Attempt to reverse-engineer, decompile, or disassemble the App or its AI models
  • Interfere with or disrupt the App's servers or networks
  • Use automated systems or bots to access the App
  • Circumvent any usage limits, credit system, access controls, or security features
  • Resell, redistribute, or commercially exploit the App's services without authorization

We reserve the right to terminate or restrict access for users who violate these terms, and to report unlawful content to the competent authorities.

Reporting & Takedown

If you believe content created with the App uses your likeness without consent, infringes your rights, or otherwise violates these Terms, please contact us at [email protected] with a description of the content and your relationship to it.

We review reports promptly and may suspend accounts, remove access, or take other appropriate action. Because generated files are stored on the user's own device after export, we may not be able to remove content that has already been distributed outside the App.

Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Guarantees that the App will be uninterrupted, error-free, or secure
  • Guarantees regarding the accuracy, realism, quality, or reliability of AI-generated results

AI processing results may vary and are not guaranteed to be perfect. Output quality depends on factors such as input resolution, lighting, face angle, occlusion, video length, and scene complexity.

Limitation of Liability

To the maximum extent permitted by applicable law, KDSTUDIO and its directors, employees, partners, and affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of data, revenue, profits, or business opportunities
  • Any damages arising from your use or inability to use the App
  • Any damages resulting from unauthorized access to your data
  • Any claim brought by a third party in connection with content you created using the App

Our total aggregate liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless KDSTUDIO and its affiliates from any claim, demand, loss, or expense (including reasonable legal fees) arising out of content you upload or generate, your violation of these Terms, or your violation of the rights of any third party.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved through negotiation in good faith. If negotiation fails, disputes shall be submitted to the competent courts of Vietnam.
